Trademark Objection

A trademark is a visual symbol, word, phrase, numbers, label, color combination or graphics that legally differentiates it from all other products of its kind. It is a unique identity that makes a product or service provided by a business entity stand out from the rest.

During the process of Registration of a Trademark, an Objection may take place. It can be filed by either the Examiner/Registrar or any third party on primarily two grounds:

  1. If the application contains incomplete/wrong information ; or
  2. If there is already a similar trademark(s) in existence.

A third party may object to the registration of a trademark in the capacity of public interest.

Upon filing an objection, the status of the application will change to “Opposed”. The grounds upon which the person is opposing the registration of the trademark must be mentioned while filing an opposition. The Applicant shall be provided a reasonable opportunity of being heard by the examiner to defend his application as per the process laid out under the Act.

Response to an Objection and Procedure:

  • Applicant shall be given a notice regarding the objection and the grounds of objection.
  • File a counter statement to the objection.
  • Registrar may call for a hearing. If the Registrar rules in favour of the applicant, the trademark will be registered. If the Registrar rules in favour of the opposing party, the trademark will be removed from the Journal and the application for registration will be rejected.
  • Applicant may file an appeal to the Intellectual Property Appellate Board (IPAB)
  • The case will be heard and the order passed by the IPAB will stand.

It is a 10 digit code which is issued by the Directorate General of Foreign Trade (DGFT). All businesses which are engaged in Import and Export of goods require registering Import Export Code. IE code has lifetime validity. Importers are not allowed to proceed without this code and exporters can’t take benefit of exports from DGFT, customs, Export Promotion Council, if they don’t have this code.

The IE Code must be quoted by importers while clearing customs. Also, banks require the importers IE Code while sending money abroad. For exporters, IE Code must be quoted while sending shipments. Import Export Code

Import Export Code (IEC) is a 10-digit code that is required by a business or a person to import/export goods/services which is issued by the Directorate General of Foreign Trade (DGFT), Ministry of Commerce and Industries, Government of India.

Shops & Establishments Registration

The Shop and Establishment Act regulates the working conditions, governs the rights of employees in the unorganized sector, and provides a list of obligations for every employer. This includes wage payments, leaves and holidays, work hours, etc.

Since this Act is covered under state legislation, the rules differ from state to state. Each state follows a separate shop and establishment regulations. The fee might vary, the process, the amount of time to deliver the certificate, the inspector in-charge, and so on will vary depending on each state.

This license is mandatory for all business entities and applies to all commercial establishments which include shops, offices, schools, hospitals, societies, charitable trusts, educational institutions which operate for the motive to earn profits. However, factories are not covered by the Shop and Establishment Act and are regulated by the Factories Act, 1948.

When registering for the Shop and Establishment Act in the case of SSI or MSME businesses in the unorganized sector, it serves as a proof for the existence of the business.

Shops and Commercial Establishments covered under this Act are required to apply for registration within 30 days from the date of commencement of business. It may be noted that the rules and regulation will change according to the respective state where the registration is being sought.

The employer shall submit the Application Form to the Inspector in-charge / local district labour officer which must contain the following:

  1. Name of the employer
  2. Name of the establishment
  3. Address of the establishment
  4. Category of Establishment
  5. Number of employees
  6. Date of commencement of operations of the Establishment
